du 24 avril 2026
modifiant la décision d’exécution (UE) 2026/582 concernant certaines mesures d’urgence relatives à la fièvre aphteuse à Chypre

LA COMMISSION EUROPÉENNE,
vu le traité sur le fonctionnement de l’Union européenne,
vu le règlement (UE) 2016/429 du Parlement européen et du Conseil du 9 mars 2016 relatif aux maladies animales transmissibles et modifiant et abrogeant certains actes dans le domaine de la santé animale («législation sur la santé animale») (1), et notamment son article 259, paragraphe 1,
considérant ce qui suit:
| (1) | La fièvre aphteuse est une maladie virale infectieuse qui touche les mammifères appartenant à l’ordre des artiodactyles et à celui des proboscidiens. Elle peut avoir une incidence grave sur la population animale concernée et la rentabilité des élevages, perturbant les mouvements d’envois de ces animaux et des produits qui en sont tirés au sein de l’Union ainsi que les exportations vers les pays tiers. En cas d’apparition d’un foyer de fièvre aphteuse chez des animaux, il existe un risque sérieux de propagation de cette maladie à d’autres établissements détenant des animaux des espèces répertoriées, telles que recensés à l’annexe du règlement d’exécution (UE) 2018/1882 de la Commission (2) (ci-après les «espèces répertoriées»). |
| (2) | Le règlement délégué (UE) 2020/687 de la Commission (3) complète les règles de lutte contre les maladies répertoriées à l’article 9, paragraphe 1, points a), b) et c), du règlement (UE) 2016/429 et définies comme des maladies des catégories A, B et C dans le règlement d’exécution (UE) 2018/1882. En particulier, les articles 21 et 22 du règlement délégué (UE) 2020/687 prévoient la mise en place d’une zone réglementée en cas d’apparition d’un foyer d’une maladie de catégorie A, à laquelle appartient la fièvre aphteuse, et l’application de certaines mesures dans cette zone. En outre, l’article 21, paragraphe 1, dudit règlement délégué prévoit que la zone réglementée comprend une zone de protection et une zone de surveillance et, si nécessaire, d’autres zones réglementées situées autour ou à proximité immédiate des zones de protection et de surveillance. |
| (3) | La décision d’exécution (UE) 2026/582 de la Commission (4), adoptée sur la base du règlement (UE) 2016/429, établit certaines mesures d’urgence relatives à l’apparition de foyers de fièvre aphteuse dans des établissements détenant des ruminants dans les districts de Larnaca et Nicosie, à Chypre. Plus particulièrement, la décision d’exécution (UE) 2026/582 prévoit que Chypre doit mettre en place des zones réglementées, comprenant des zones de protection et de surveillance, ainsi qu’une autre zone réglementée, conformément à l’article 21 du règlement délégué (UE) 2020/687, dans lesquelles les mesures devant être appliquées dans les zones de protection et de surveillance, ainsi que dans l’autre zone réglementée, doivent être appliquées au moins jusqu’aux dates indiquées à l’annexe de ladite décision d’exécution, et que les zones de protection et de surveillance, ainsi que l’autre zone réglementée, doivent comprendre au moins les zones énumérées dans ladite annexe. La décision d’exécution (UE) 2026/582 a été modifiée par la décision d’exécution (UE) 2026/782 de la Commission (5). |
| (4) | Depuis l’adoption de la décision d’exécution (UE) 2026/782, les mesures d’urgence devant être appliquées dans les zones de protection et de surveillance ainsi que dans l’autre zone réglementée énumérées à l’annexe de ladite décision ainsi que le calendrier de leur application ont été réexaminés à la lumière des informations fournies par Chypre, notamment eu égard aux dates du nettoyage et de la désinfection préliminaires des établissements touchés, qui doivent être effectués conformément au règlement délégué (UE) 2020/687. Par conséquent, la durée des mesures d’urgence dans ces zones de protection et de surveillance doit être révisée. |
| (5) | En outre, depuis l’adoption de la décision d’exécution (UE) 2026/782, de nouveaux foyers de fièvre aphteuse sont apparus dans des établissements des districts de Larnaca et de Nicosie, à Chypre, y compris en dehors des zones de protection et de surveillance actuellement mentionnées à l’annexe de la décision d’exécution (UE) 2026/582. |
| (6) | En conséquence, compte tenu de la situation épidémiologique actuelle en ce qui concerne la fièvre aphteuse à Chypre, et afin de prévenir la propagation de cette maladie dans cet État membre, dans d’autres États membres ou dans des pays tiers, il est nécessaire de réexaminer d’urgence les zones actuellement répertoriées en tant que zones de protection et de surveillance ou en tant qu’autre zone réglementée, à l’annexe de la décision d’exécution (UE) 2026/582, pour les adapter tant dans l’espace que dans le temps, le cas échéant, et de mettre en place de nouvelles zones de protection et de surveillance en tenant compte des plus récents foyers qui se sont déclarés à Chypre. Ces mesures sont également nécessaires pour prévenir toute perturbation inutile des échanges dans l’Union et éviter que des pays tiers n’imposent des entraves injustifiées aux échanges commerciaux. |
| (7) | Il y a donc lieu de modifier la décision d’exécution (UE) 2026/582 en conséquence. |
| (8) | Les mesures prévues par la présente décision sont conformes à l’avis du comité permanent des végétaux, des animaux, des denrées alimentaires et des aliments pour animaux, |
A ADOPTÉ LA PRÉSENTE DÉCISION:
Article premier
L’annexe de la décision d’exécution (UE) 2026/582 est remplacée par le texte figurant à l’annexe de la présente décision.
Article 2
La République de Chypre est destinataire de la présente décision.
