DÉCISION D’EXÉCUTION (UE) 2021/396 DE LA COMMISSION
du 3 mars 2021
modifiant l’annexe de la décision d’exécution (UE) 2020/1809 concernant certaines mesures de protection motivées par l’apparition de foyers d’influenza aviaire hautement pathogène dans certains États membres

LA COMMISSION EUROPÉENNE,
vu le traité sur le fonctionnement de l’Union européenne,
vu la directive 89/662/CEE du Conseil du 11 décembre 1989 relative aux contrôles vétérinaires applicables dans les échanges intracommunautaires dans la perspective de la réalisation du marché intérieur (1), et notamment son article 9, paragraphe 4,
vu la directive 90/425/CEE du Conseil du 26 juin 1990 relative aux contrôles vétérinaires applicables dans les échanges à l’intérieur de l’Union de certains animaux vivants et produits dans la perspective de la réalisation du marché intérieur (2), et notamment son article 10, paragraphe 4,
vu la directive 2005/94/CE du Conseil du 20 décembre 2005 concernant des mesures communautaires de lutte contre l’influenza aviaire et abrogeant la directive 92/40/CEE (3), et notamment son article 63, paragraphe 4,
considérant ce qui suit:
| (1) | La décision d’exécution (UE) 2020/1809 de la Commission (4) a été adoptée à la suite de l’apparition, dans certains États membres, de foyers d’influenza aviaire hautement pathogène (ci-après l’«IAHP») dans des exploitations où sont détenus des volailles ou d’autres oiseaux captifs, et à la suite de l’établissement de zones de protection et de surveillance par les États membres concernés, conformément aux dispositions de la directive 2005/94/CE du Conseil. |
| (2) | La décision d’exécution (UE) 2020/1809 prévoit que les zones de protection et de surveillance établies par les États membres figurant dans son annexe, conformément à la directive 2005/94/CE, comprennent au moins les zones définies à ladite annexe comme zones de protection et de surveillance. |
| (3) | L’annexe de la décision d’exécution (UE) 2020/1809 a été récemment modifiée par la décision d’exécution (UE) 2021/335 de la Commission (5), à la suite de l’apparition de nouveaux foyers d’IAHP chez des volailles ou d’autres oiseaux captifs en Tchéquie, en Estonie, en Allemagne, en Pologne et en Suède, ce qui devait figurer dans l’annexe. |
| (4) | Depuis l’adoption de la décision d’exécution (UE) 2021/335, la Tchéquie a notifié la Commission l’apparition de nouveaux foyers d’IAHP du sous-type H5N8 dans des exploitations où sont détenus des volailles ou d’autres oiseaux captifs dans les régions de Vysočina, de Bohême du Sud et de Plzeň. |
| (5) | De plus, les Pays-Bas ont notifié à la Commission l’apparition d’un nouveau foyer d’IAHP du sous-type H5N8 dans une exploitation où sont détenus des volailles ou d’autres oiseaux captifs dans la province du Brabant-Septentrional. |
| (6) | En outre, l’Italie a notifié à la Commission l’apparition de nouveaux foyers d’IAHP du sous-type H5N8 dans des exploitations où sont détenus des volailles ou d’autres oiseaux captifs dans les provinces de Pordenone et de Padoue. |
| (7) | L’Allemagne a elle aussi notifié à la Commission l’apparition de nouveaux foyers d’IAHP du sous-type H5N8 dans des exploitations où sont détenus des volailles ou d’autres oiseaux captifs, dans les districts de Maerkisch-Oderland, Uckermark, Vorpommern-Rügen, Diepholz et Cloppenburg. |
| (8) | Par ailleurs, la France a notifié à la Commission de nouveaux foyers d’IAHP du sous-type H5N8 dans des exploitations où sont détenus des volailles ou d’autres oiseaux captifs dans le département du Gers. |
| (9) | De plus, la Suède a notifié à la Commission l’apparition d’un nouveau foyer d’IAHP du sous-type H5N8 dans une exploitation où sont détenus des volailles ou d’autres oiseaux captifs dans la municipalité de Linköping. |
| (10) | En outre, la Roumanie a notifié à la Commission l’apparition d’un foyer récent d’IAHP du sous-type H5N5 dans une exploitation où sont détenus des volailles ou d’autres oiseaux captifs dans le comté de Timiș. |
| (11) | Le Danemark a également notifié à la Commission l’apparition d’un nouveau foyer d’IAHP du sous-type H5N8, dans une exploitation où sont détenus des volailles ou d’autres oiseaux captifs dans la municipalité de Bornholm. |
| (12) | Ces foyers en Tchéquie, au Danemark, en France, en Allemagne, en Italie, aux Pays-Bas, en Roumanie et en Suède se situent en dehors des zones actuellement mentionnées en annexe de la décision d’exécution (UE) 2020/1809, et les autorités compétentes de ces États membres ont pris les mesures nécessaires conformément à la directive 2005/94/CE, y compris l’établissement de zones de protection et de surveillance autour de ces foyers. |
| (13) | La Commission a examiné les mesures prises par la Tchéquie, le Danemark, la France, l’Allemagne, l’Italie, les Pays-Bas, la Roumanie et la Suède et a pu s’assurer que les limites des zones de protection et de surveillance établies par les autorités compétentes de ces États membres se trouvaient à une distance suffisante des exploitations où les foyers récents d’IAHP ont été confirmés. |
| (14) | En vue de prévenir toute perturbation inutile des échanges dans l’Union et afin d’éviter que des pays tiers n’imposent des entraves injustifiées aux échanges commerciaux, il est nécessaire de décrire rapidement au niveau de l’Union les nouvelles zones de protection et de surveillance établies par la Tchéquie, le Danemark, la France, l’Allemagne, l’Italie, les Pays-Bas, la Roumanie et la Suède conformément à la directive 2005/94/CE, en collaboration avec ces États membres. |
| (15) | Aussi convient-il de modifier les zones de protection et de surveillance énumérées pour la Tchéquie, la France, l’Allemagne, l’Italie, la Roumanie et la Suède dans l’annexe de la décision d’exécution (UE) 2020/1809. |
| (16) | Il convient en outre que des zones de protection et de surveillance soient énumérées pour le Danemark et les Pays-Bas dans l’annexe de la décision d’exécution (UE) 2020/1809. |
| (17) | En conséquence, il convient de modifier l’annexe de la décision d’exécution (UE) 2020/1809 afin d’actualiser la définition des zones au niveau de l’Union de manière à prendre en considération les nouvelles zones de protection et de surveillance dûment établies par les autorités compétentes de la Tchéquie, du Danemark, de la France, de l’Allemagne, de l’Italie, des Pays-Bas, de la Roumanie et de la Suède conformément à la directive 2005/94/CE et la durée des restrictions qui y sont applicables. |
| (18) | Il y a donc lieu de modifier en conséquence la décision d’exécution (UE) 2020/1809. |
| (19) | Compte tenu de l’urgence de la situation épidémiologique dans l’Union en ce qui concerne la propagation de l’IAHP, il importe que les modifications à apporter à l’annexe de la décision d’exécution (UE) 2020/1809 par la présente décision prennent effet le plus rapidement possible. |
| (20) | Les mesures prévues par la présente décision sont conformes à l’avis du comité permanent des végétaux, des animaux, des denrées alimentaires et des aliments pour animaux, |
A ADOPTÉ LA PRÉSENTE DÉCISION:
Article premier
L’annexe de la décision d’exécution (UE) 2020/1809 est remplacée par le texte figurant en annexe de la présente décision.
Article 2
Les États membres sont destinataires de la présente décision.

| Landkreis Diepholz Der Sperrbezirk umschreibt Teile der Gemeinde Weyhe und der Stadt Syke. Er beginnt im Norden am Schnittpunkt der Kreisgrenze mit der Bahnlinie Bremen-Osnabrück und verläuft von dort aus entlang der Bahnlinie in südliche Richtung bis zur Einmündung der Bundesstraße 6, von dort weiter südöstlich bis zum Schnittpunkt mit der Kreisstraße 122. Die Grenze des Sperrbezirks verläuft weiter in östlicher Richtung mit dem Schnittpunkt der Landesstraße 333 und verläuft entlang dieser bis zur östlichen Kreisgrenze. | Landkreis Verden Die nördliche Grenze des Sperrbezirks verläuft entlang der Weser stromaufwärts in östlicher Richtung. Im Bereich des Bollener Eschs verläuft die Grenze entlang des Weserzuflusses „Rieder Grenzgraben“ weiter in südlicher Richtung. Entlang der Landstraße L203 geht es weiter in westlicher Richtung bis zum „Rieder Graben A“. Dem „Rieder Graben A“ stromaufwärts folgend in südlicher Richtung bis zur Thedinghausener Straße (K20) geht es weiter in westlicher Richtung bis zur Straße Börtelsdamm (im späteren Verlauf „Rienstraße“). Dann weiter in südlicher Richtung der Straße Börtelsdamm/Rienstraße folgend bis zur Felder Dorfstraße (L331).
