DÉCISION D’EXÉCUTION (UE) 2021/906 DE LA COMMISSION
du 3 juin 2021
modifiant l’annexe de la décision d’exécution (UE) 2021/641 concernant des mesures d’urgence motivées par l’apparition de foyers d’influenza aviaire hautement pathogène dans certains États membres
[notifiée sous le numéro C(2021) 4096]

LA COMMISSION EUROPÉENNE,
vu le traité sur le fonctionnement de l’Union européenne,
vu le règlement (UE) 2016/429 du Parlement européen et du Conseil du 9 mars 2016 relatif aux maladies animales transmissibles et modifiant et abrogeant certains actes dans le domaine de la santé animale («législation sur la santé animale») (1), et notamment son article 259, paragraphe 1, point c),
considérant ce qui suit:
| (1) | L’influenza aviaire hautement pathogène (IAHP) est une maladie virale infectieuse qui touche les oiseaux; elle peut avoir d’importantes répercussions sur la rentabilité de l’aviculture et, partant, perturbe les échanges à l’intérieur de l’Union et les exportations vers les pays tiers. Les virus de l’IAHP peuvent infecter les oiseaux migrateurs, dès lors susceptibles de disséminer ces virus sur de longues distances pendant leurs migrations d’automne et de printemps. Par conséquent, la présence des virus de l’IAHP chez les oiseaux sauvages fait planer en permanence une menace d’introduction directe ou indirecte de ces virus dans les exploitations où sont détenus des volailles ou des oiseaux captifs. En cas d’apparition d’un foyer d’IAHP, il existe un risque que l’agent pathogène se propage à d’autres exploitations où sont détenus des volailles ou des oiseaux captifs. |
| (2) | Le règlement (UE) 2016/429 établit un nouveau cadre législatif pour la prévention des maladies transmissibles aux animaux ou aux êtres humains et la lutte contre ces maladies. L’IAHP relève de la définition d’une maladie répertoriée aux fins dudit règlement et est soumise aux dispositions en matière de prévention et de lutte qui y sont énoncées. En outre, le règlement délégué (UE) 2020/687 de la Commission (2) complète le règlement (UE) 2016/429 en ce qui concerne les règles de prévention de certaines maladies répertoriées et de lutte contre celles-ci, y compris les mesures de lutte contre l’IAHP. |
| (3) | La décision d’exécution (UE) 2021/641 de la Commission (3) a été adoptée dans le cadre du règlement (UE) 2016/429 et établit des mesures de lutte contre les foyers d’IAHP. |
| (4) | La décision d’exécution (UE) 2021/641 prévoit plus particulièrement que les zones de protection et de surveillance établies par les États membres à la suite de l’apparition de foyers d’IAHP conformément au règlement délégué (UE) 2020/687 doivent comprendre au moins les zones de protection et de surveillance énumérées en annexe de ladite décision d’exécution. |
| (5) | L’annexe de la décision d’exécution (UE) 2021/641 a été récemment modifiée par la décision d’exécution (UE) 2021/846 (4) de la Commission, à la suite de l’apparition d’autres foyers d’IAHP chez des volailles ou des oiseaux captifs en Tchéquie, en Allemagne, en France et en Pologne, ce qui devait figurer dans l’annexe. |
| (6) | Depuis l’adoption de la décision d’exécution (UE) 2021/846, la Pologne a notifé à la Commission l’apparition de nouveaux foyers d’IAHP du sous-type H5N8 dans des exploitations détenant des volailles ou des oiseaux captifs situées dans les voïvodies de Mazowieckie, de Warmińsko-Mazurskie et de Lubelskie. |
| (7) | De plus, les Pays-Bas ont notifié à la Commission l’apparition d’un foyer d’IAHP du sous-type H5N8 dans une exploitation détenant des volailles ou des oiseaux captifs dans la province de Limburg. |
| (8) | Le foyer confirmé aux Pays-Bas se situe à proximité immédiate de la frontière avec la Belgique. En conséquence, les autorités compétentes de ces deux États membres ont dûment collaboré en ce qui concerne l’établissement de la zone de surveillance nécessaire, conformément au règlement délégué (UE) 2020/687, étant donné que la zone de surveillance s’étend jusqu’en Belgique. |
| (9) | En outre, l’Allemagne a notifié à la Commission l’apparition d’un nouveau foyer d’IAHP du sous-type H5N8 dans une exploitation détenant des volailles ou des oiseaux captifs dans la ville hanséatique libre de Brême. |
| (10) | De plus, la Lituanie a notifié à la Commission l’apparition d’un foyer d’IAHP du sous-type H5N8 dans une exploitation détenant des volailles ou des oiseaux captifs dans le comté de Tauragé. |
| (11) | Ces nouveaux foyers en Allemagne, en Lituanie, aux Pays-Bas et en Pologne se situent en dehors des zones actuellement mentionnées en annexe de la décision d’exécution (UE) 2021/641 et les autorités compétentes de ces États membres ont pris les mesures nécessaires de lutte contre la maladie conformément au règlement délégué (UE) 2020/687, y compris l’établissement de zones de protection et de surveillance autour de ces nouveaux foyers. |
| (12) | La Commission a examiné ces mesures de lutte contre la maladie prises par la Belgique, l’Allemagne, la Lituanie, les Pays-Bas et la Pologne en collaboration avec ces États membres et a pu s’assurer que les limites des zones de protection et de surveillance définies par les autorités compétentes de ces États membres se trouvaient à une distance suffisante de toute exploitation où un foyer d’IAHP a été confirmé. |
| (13) | En vue de prévenir toute perturbation inutile des échanges dans l’Union et afin d’éviter que des pays tiers n’imposent des entraves injustifiées aux échanges commerciaux, il est nécessaire de décrire rapidement au niveau de l’Union les nouvelles zones de protection et de surveillance établies par l’Allemagne, la Lituanie, les Pays-Bas et la Pologne en collaboration avec ces États membres, conformément au règlement délégué (UE) 2020/687. |
| (14) | En outre, il est également nécessaire de décrire rapidement à l’échelle de l’Union la nouvelle zone de surveillance établie par la Belgique conformément au règlement délégué (UE) 2020/687, en collaboration avec cet État membre. |
| (15) | Il y a donc lieu de modifier les zones de protection et de surveillance énumérées pour l’Allemagne, la Pologne et la zone de surveillance énumérée pour la Belgique en annexe de la décision d’exécution (UE) 2021/641. |
| (16) | Il convient en outre que des zones de protection et de surveillance soient énumérées pour la Lituanie et les Pays-Bas dans l’annexe de la décision d’exécution (UE) 2021/641. |
| (17) | En conséquence, il y a lieu de modifier l’annexe de la décision d’exécution (UE) 2021/641 afin d’actualiser la définition des zones au niveau de l’Union de manière à prendre en considération les nouvelles zones de protection et de surveillance dûment établies par les autorités compétentes allemandes, lituaniennes, néerlandaises et polonaises et la nouvelle zone de surveillance établie par la Belgique conformément au règlement délégué (UE) 2020/687, ainsi que la durée des restrictions qui y sont applicables. |
| (18) | Il y a donc lieu de modifier en conséquence la décision d’exécution (UE) 2021/641. |
| (19) | Compte tenu de l’urgence de la situation épidémiologique dans l’Union en ce qui concerne la propagation de l’IAHP, il importe que les modifications à apporter à l’annexe de la décision d’exécution (UE) 2021/641 par la présente décision prennent effet le plus rapidement possible. |
| (20) | Les mesures prévues par la présente décision sont conformes à l’avis du comité permanent des végétaux, des animaux, des denrées alimentaires et des aliments pour animaux, |
A ADOPTÉ LA PRÉSENTE DÉCISION:
Article premier
L’annexe de la décision d’exécution (UE) 2021/641 est remplacée par le texte figurant à l’annexe de la présente décision.
Article 2
Les États membres sont destinataires de la présente décision.

| Landkreis Diepholz Das Gebiet umfasst einen Teil der Gemeinde Stuhr im nördlichen Kreisgebiet. Er beginnt östlich vom Grollander See entlang der Kreisgrenze und verläuft südöstlich bis zur Einmündung in den Stuhrgraben. Entlang des Stuhrgrabens verläuft er in südwestlicher Richtung bis zur L 337 und folgt dieser in Richtung Stuhr bis zum Schnittpunkt mit der „Stuhrer Landstraße“. Die Grenze des Sperrbezirks folgt dieser bis zur „Blockener Straße“ (K 111). Der „Blockener Straße“ folgt sie in Richtung der Autobahn A 1 bis zur Einmündung in den „Barkener Weg“. Dann folgt sie dem „Barkener Weg“ in westlicher Richtung bis zum Schnittpunkt mit der „Moordeicher Landstraße“ (L 336). Dieser folgt sie in südwestlicher Richtung bis zur Einmündung in den „Birkenweg“. Danach verläuft sie über die Straße „Am Wilshauser Moor“ über die „Wilshauser Straße“ bis zur Kreuzung mit der „Schulstraße“ in Richtung Varrel. Von der „Schulstraße“ aus führt sie über die „Holländer Straße“ bis zur Einmündung in die „Delmenhorster Straße“. Der „Delmenhorster Straße“ folgt sie in nordwestlicher Richtung bis zur Kreuzung „Syker Straße“/ „Varreler Landstraße“, wo die Kreisgrenze verläuft. | Stadt Delmenhorst Das Gebiet umfasst Teile im nordöstlichen Bereich der Stadt Delmenhorst an der Grenze zu Bremen. Die östliche Begrenzung des Sperrbezirks verläuft entlang der Stadtgrenze zu Bremen und dem Landkreis Diepholz bis zum Schnittpunkt mit der Varreler Landstr., entlang dieser in westlicher Richtung bis zur Syker Str. und von dort in nordwestlicher Richtung bis zur Langenwischstr., hier weiter bis zum Schnittpunkt mit der Tannenbergstr. und in nördlicher Richtung weiter bis zur Bremer Straße. Weiter über Kreuzweg, Sommerweg links in den Sommergarten. Hier entlang einer gedachter Linie über die Bahn und den Bürgerkampweg bis zur Heidkruger Bäke, weiter durch Brandhöfen bis zum Ende der Straße Auf dem Alrusch, weiter entlang Fuhlriedeweg und entlang einer gedachten Linie bis zur Ochtum und dieser folgend bis zur Stadtgrenze zu Bremen. | Du 18.6.2021 au 26.6.2021 |
| Landkreis Diepholz Das Gebiet beginnt an der östlichen Kreisgrenze in Höhe der A 1 und verläuft dann in südöstlicher Richtung entlang der Weser bis zur Schnittstelle mit der Bahnlinie und folgt dieser in Richtung Osnabrück in südlicher Richtung. An der Schnittstelle mit der Straße „Am Weitufer“ folgt sie dieser bis zum Übergang in „Im Bruch“. Der Straße „Im Bruch“ folgt die Grenze des Beobachtungsgebietes weiterhin in südlicher Richtung bis zur Einmündung in die Hauptstraße (L 335). Der L 335 folgt sie kurz in Richtung Leeste und mündet an der Kreuzung „Rumpsfelder Heide“/ „Rathausplatz“ in die „Rumpsfelder Heide“ ein. Diese folgt im weiteren Verlauf der „Rumpsfelder Heide“ bis zur Einmündung in „Hinter dem Felde“. Der Straße „Hinter dem Felde“ folgt sie bis zur Kreuzung mit der „Melchiorshauserstraße“, in die sie in Richtung B 6 einmündet. Sie überquert die Kreuzung „Syker Straße“/ B 6 und folgt der „Ristedter Straße“ bis zur Schnittstelle mit den Bahngleisen, denen sie entlang der Kreisgrenze bis zur Schnittstelle mit dem „Heudamm“ folgt. Dem „Heudamm“ folgt sie kurz in Richtung der Straße „Zum Heidkönig“, der sie bis zur Einmündung in die „Ristedter Straße“ (K 113) folgt. Ausgehend von der „Ristedter Straße“ verläuft die Grenze des Beobachtungs-gebietes dann durch Warwe entlang der „Warwer Straße“( K 114) in Richtung Fahrenhorst. Ab der Kreuzung mit der Straße B 51 verläuft sie über die „Kirchseelter Straße“ und die „Waldstraße“ über den „Bargweg“ auf den „Kettinger Mühlenweg“ bis zur Einmündung in die L 338 „Wildeshauser Straße“, auf der die Kreisgrenze verlauft. Die westliche Grenze des Beobachtungsgebietes verläuft dann entlang der Kreisgrenze nordwestlich in Richtung Bremen bis sie zum nordöstlichen Ausgangspunkt zurückkehrt. | 26.6.2021 |
| Landkreis Diepholz Das Gebiet umfasst einen Teil der Gemeinde Stuhr im nördlichen Kreisgebiet. Er beginnt östlich vom Grollander See entlang der Kreisgrenze und verläuft südöstlich bis zur Einmündung in den Stuhrgraben. Entlang des Stuhrgrabens verläuft er in südwestlicher Richtung bis zur L 337 und folgt dieser in Richtung Stuhr bis zum Schnittpunkt mit der „Stuhrer Landstraße“. Die Grenze des Sperrbezirks folgt dieser bis zur „Blockener Straße“ (K 111). Der „Blockener Straße“ folgt sie in Richtung der Autobahn A 1 bis zur Einmündung in den „Barkener Weg“. Dann folgt sie dem „Barkener Weg“ in westlicher Richtung bis zum Schnittpunkt mit der „Moordeicher Landstraße“ (L 336). Dieser folgt sie in südwestlicher Richtung bis zur Einmündung in den „Birkenweg“. Danach verläuft sie über die Straße „Am Wilshauser Moor“ über die „Wilshauser Straße“ bis zur Kreuzung mit der „Schulstraße“ in Richtung Varrel. Von der „Schulstraße“ aus führt sie über die „Holländer Straße“ bis zur Einmündung in die „Delmenhorster Straße“. Der „Delmenhorster Straße“ folgt sie in nordwestlicher Richtung bis zur Kreuzung „Syker Straße“/ „Varreler Landstraße“, wo die Kreisgrenze verläuft.
