RÈGLEMENT (UE) 2019/220 DE LA COMMISSION
du 6 février 2019
modifiant le règlement (CE) no 865/2006 portant modalités d'application du règlement (CE) no 338/97 du Conseil relatif à la protection des espèces de faune et de flore sauvages par le contrôle de leur commerce
LA COMMISSION EUROPÉENNE,
vu le traité sur le fonctionnement de l'Union européenne,
vu le règlement (CE) no 338/97 du Conseil du 9 décembre 1996 relatif à la protection des espèces de faune et de flore sauvages par le contrôle de leur commerce (1), et en particulier son article 19, paragraphe 4,
considérant ce qui suit:
| (1) | Le règlement (CE) no 865/2006 de la Commission (2) a pour objet de mettre en œuvre le règlement (CE) no 338/97 et de garantir le respect intégral des dispositions de la convention sur le commerce international des espèces de faune et de flore sauvages menacées d'extinction (CITES) (ci-après, la «convention»). |
| (2) | Lors de la dix-septième session de la conférence des parties à la convention, il a été décidé d'apporter à la résolution Conf. 11.20 (Rev. CoP17) de la CITES certaines modifications concernant le commerce des éléphants et des rhinocéros vivants. Au cours de cette même session, la liste des références normalisées de nomenclature figurant en annexe de la résolution Conf. 12.11 (Rev. CoP17) de la CITES qui doit être utilisée pour indiquer les noms scientifiques des espèces sur les permis et les certificats, a été restructurée et mise à jour. |
| (3) | Lors de sa 67e réunion, le comité permanent de la convention a adopté des lignes directrices révisées pour la soumission des rapports annuels. Ces lignes directrices comprennent des codes révisés qui doivent être inclus dans la description des spécimens, ainsi que les unités de mesure à utiliser dans les permis et les certificats. |
| (4) | Il est nécessaire d'incorporer dans le règlement (CE) no 865/2006 les modifications apportées aux résolutions Conf. 11.20 et Conf. 12.11, ainsi que les codes et les unités de mesures révisés. |
| (5) | Il y a donc lieu de modifier le règlement (CE) no 865/2006 en conséquence. |
| (6) | Les mesures prévues au présent règlement sont conformes à l'avis du comité du commerce des espèces de faune et de flore sauvages, |
A ADOPTÉ LE PRÉSENT RÈGLEMENT:
Article premier
Le règlement (CE) no 865/2006 est modifié comme suit:
| 1. | l'article 5 ter suivant est inséré: «Article 5 ter Contenu spécifique des permis et des certificats pour les rhinocéros et les éléphants vivants Les permis et les certificats délivrés en vertu de l'article 4 ou de l'article 5 du règlement (CE) no 338/97 pour l'importation ou la réexportation de rhinocéros ou d'éléphants vivants issus des populations inscrites à l'annexe B dudit règlement contiennent une condition indiquant que la corne ou l'ivoire de ces animaux ou de leur progéniture ne peut pas faire l'objet d'un commerce ou d'activités commerciales au sein de l'Union. En outre, les rhinocéros ou les éléphants vivants issus de ces populations ne peuvent pas faire l'objet de chasse sportive en dehors de leur aire de répartition historique»; |
| 2. | les annexes VII et VIII sont remplacées par le texte figurant à l'annexe du présent règlement. |
Article 2
Le présent règlement entre en vigueur le vingtième jour suivant celui de sa publication au Journal officiel de l'Union européenne.
Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans tout État membre.
